General Terms and conditions

1. Scope of Application

These General Terms and Conditions of Balance Tools - Ingo Fechner (hereinafter referred to as ”Seller”) shall apply to all contracts concluded between a consumer (§ 13 BGB (German Civil Code)) and the Seller relating to all goods and/or services presented in the online shop of the Seller.

A consumer pursuant to these General Terms and Conditions is every natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity.

3. Offer and Conclusion of the Contract

If you submit an order for goods via this site by clicking 'Submit order', your order is an offer to us to buy the goods on our website.

We will acknowledge receipt of your order by sending you an automatically generated email accepting your order. With this email the contract will be concluded.

 

4. Right of withdrawal

Consumers are entitled to the right of cancellation.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Price and delivery costs

5.1 Unless otherwise stated in the product descriptions, prices indicated are end prices and include the statutory value-added tax. Any possible additional delivery and dispatch costs are specified separately in the respective product description.

5.2 Shipping costs depend on the destination of delivery. Choose your destination in your shopping basket: 'shipping method' (within Germany, Austria, EU-countries or Switzerland or Norway). Your shipping costs will then be displayed in your shopping basket before you submit your order. Here you find an overview :

5.3 The minimum order value is 6,50 € (incl. VAT) based on product value.

 

6. Shipment

6.1 Shipping will be proceeded by postal mail or  DHL  within Germany as well as to EU-countries named under ‘Shipping+Payment’ and to Switzerland and Norway.

6.2 For shipment in non-EU countries import sales taxes and duties are levied.

6.3 The delivery time takes 3-5 workdays within Germany. Differing delivery times will be indicated on the corresponding product page. The shipment to other EU-countries and to Switzerland takes two more days.

 

7. Payment

7.1 Payment for goods can be made by one of the following payment methods: SEPA Direct Debit Scheme, by Payment in advance (bank transfer) or through PayPal

7.2 When choosing the payment method "PayPal", the handling of payments is done via the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the conditions of use which can viewed at http://www.paypal.com .

7.3 Special agreement for payments using SEPA-Direct Debit Scheme/ SEPA Direct Debit Mandate
By choosing ‘SEPA Direct debit scheme’ as payment method you authorise Ingo Fechner, Balance Tools (DE33ZZZ00000923300), to send instructions to your bank to debit your account and your bank to debit your account in accordance with the instructions from Ingo Fechner, Balance Tools. As part of your rights, you are entitled to a refund from your bank under the terms and conditions of your agreement with your bank. A refund must be claimed within 8 weeks starting from the date on which your account was debited.

The unique Mandate Reference will be sent to you by email before the direct debit is being transacted for the first time.

SEPA’s default pre-notification period (Pre-Notification), will be reduced to 7 days.

Any costs incurred as a result of the direct debit being refused or reversed are to be borne by the purchaser, unless Ingo Fechner – Balance Tools is responsible for the refusal or reversal.

 

8. Reservation of Proprietary Rights

The Seller retains title of ownership to the delivered goods until the purchase price owed has been paid in full.

Then choose your payment method (SEPA direct debit scheme, Payment in advance (bank transfer) or PayPal).  In the last step you will be shown an overview of your order. You may check the details again and also cancel the order if applicable. By clicking the button 'Buy now' you send your order.
